Terms of Service

Thank you for using Airnoise.io. By using Airnoise.io, you agree to our Terms of Service, which is a legal agreement. These Terms of Service govern your use of the Airnoise.io service and our responsibilities to you.

1. General Rules

To use Airnoise.io, you must (a) be at least thirteen (13) years of age; (b) complete the registration process; (c) provide current and accurate information; (d) agree to these Terms; and (e) promise to follow these rules:

  • You are responsible for all aircraft noise complaints and other content you generate when using Airnoise.io;
  • You will use Airnoise.io to generate noise complaints for yourself and your household, and you will not submit complaints in the name of any other person who is not a member of your household;
  • You will use Airnoise.io in compliance with all applicable laws, rules, and regulations;
  • You will not attempt to use any deep-link, page-scrape, robot, crawl, index, spider, click spam, macro programs, Internet agent, or other automatic device, program, algorithm or methodology which does the same things, to use, access, copy, acquire information, generate complaints, input information, store information, search, generate searches, or monitor any portion of the Airnoise service or company;
  • You will not use Airnoise.io to upload, transmit, or otherwise distribute any objectionable content, as solely determined by us.

If you break any of your promises above or any of the rules in these Terms, we may terminate your account.

As long as you comply with our Terms of Service, we grant you a non-exclusive, non-transferable, limited privilege to use Airnoise.io. Your use of Airnoise.io is at your own risk.

2. Interactions with Third-Party Systems

Your use of Airnoise.io to submit aircraft noise complaints may require Airnoise.io to interact on your behalf with third-party web sites, services, and data systems not controlled by Airnoise.io. Your use of Airnoise.io means you agree that we may take the following actions on your behalf:

  • Submit aircraft noise complaints to appropriate airport authorities and agencies which may include your personal contact information, via web form submission, email, computer-to-computer interaction, and other mechanisms;
  • Login to web sites and systems using credentials supplied by you in order to file aircraft noise complaints;
  • Send emails containing information about your noise complaints to third parties selected by you;
  • Send SMS (text) messages containing aircraft noise complaint information that you initiate;
  • Make automated voice calls on your behalf to airport authorities and other public agencies in order to file noise complaints.

You have control over any and all of these actions and can opt to not have Airnoise.io perform these actions on your behalf at any time.

3. Aircraft Noise Complaint Submissions

Airnoise.io will try on a best effort basis to submit all noise complaints that you generate. We reserve the right to remove complaints from the system or prevent submission of complaints that we deem to be spurious, inaccurate, or contrary to the policies of any agency receiving noise complaints.

Your use of Airnoise.io constitutes acknowledgement that third-party services not under our control may be interrupted, blocked, disabled, or otherwise not available for use by Airnoise.io and that such actions may prevent Airnoise.io from generating or submitting aircraft noise complaints on your behalf.

Information provided to airport authorities in conjunction with filing airport noise complaints is considered part of the public record, therefore any information you provide, including your name, address, phone number and other personally-identifiable information, should be assumed to be accessible under public records or freedom of information requests. Anonymous noise complaints are not accepted and any attempt to hide, shield, or obfuscate the identity of an account holder in Airnoise.io is grounds for immediate account termination.

4. Passwords and Accounts

You’re responsible for keeping your account email and password confidential. You’re also responsible for any account that you have access to. You agree to notify us immediately of any unauthorized use of your account(s). You are solely responsible for all noise complaints generated from your account, including complaints generated from within the Airnoise.io dashboard, via the Airnoise button, via SMS message, and any other mechanism we provide to initiate aircraft noise complaints. With great power comes great responsibility!

You will not represent that you are any other individual or entity unless such individual or entity has given you express permission to act on their behalf. You will maintain your correct legal first and last name on your account and will not use pseudonym, fake name, or otherwise mask your actual identity.

5. Payment Terms

The free trial offer entitles new, registered users to a thirty (30) day free trial of the Airnoise.io service, excluding the cost of the Airnoise button. For all subscription plans, you authorize us to charge you according to the plan you choose at the then current plan rate, and any other charges you may incur in connection with your use of Airnoise.io, such as taxes, duties, and possible transaction fees.

Airnoise.io offers free accounts that can make a limited number of noise complaints each calendar month. Free accounts may also be limited in the number of features they offer compared to paid accounts, including, but not limited to, the ability to use the Airnoise button, share complaint information with third parties, and other features. You may upgrade to a paid subscription at any time from a free account. You may only create and operate one free account for yourself at any given time.

A valid credit card is required for you to initiate using a paid Airnoise.io subscription on a month-to-month basis, including when starting the thirty (30) day free trial period. Subscriptions are billed in advance on a monthly basis and are non-refundable. There will be no refunds or credits for partial months, for account upgrades or downgrades.

6. Cancellation and Termination

You are solely responsible for the proper cancellation of your account. You may cancel your account at any time by going to your personal Billing details page and closing your account. An email or phone request to cancel your account is not considered cancellation. You will not be charged after cancellation. There is no cancellation fee.

In the event of cancellation or termination your account will be immediately disabled, and your account and information cannot be recovered once the account is closed. We retain the right to retain or delete data provided to us by you at our sole discretion.

We also reserve the right, but do not have any obligation, to refuse service to anyone and close your account(s) without notice for any or no reason at all.
